2.2 Affiliate Links

Some outbound booking links are affiliate links, meaning we may earn a commission if a user books through an external platform. Affiliate earnings do not influence listing placement unless explicitly stated under future premium features.

3. Eligibility

To create an owner account, you must:

• Be at least 18 years old
• Be authorized to represent your business or property
• Provide truthful information during registration

General visitors may browse the platform without creating an account.

6. Intellectual Property

6.1 Our Content

All content created by Zinkwazi Beach Stays—including site design, layout, branding, copywriting, and unique media—is our intellectual property and may not be copied or redistributed without permission.

6.2 Owner Content

Owners retain full ownership of the content they upload but grant Zinkwazi Beach Stays:

• A non-exclusive, worldwide, royalty-free license
• To display and promote their listing content on our platform
• To use listing content in marketing materials (unless the owner opts out in writing)

Owners may delete their account and listing at any time, after which the content will be removed from public view within a reasonable period.

7. External Links & Third-Party Services

Our site contains links to third-party booking platforms and websites. We:

• Do not control third-party content
• Do not endorse or guarantee third-party services
• Are not responsible for disputes, cancellations, payment issues, or fraud occurring on external platforms

Users must review the terms and privacy policies of each third-party service independently.

9. Limitation of Liability

To the maximum extent permitted under South African law:

• We are not liable for disputes or damages resulting from bookings made through external platforms.
• Our maximum liability is limited to R1,000 or the total amount paid to us by the user during the previous 12 months—whichever is lower.
• We are not liable for indirect, incidental, punitive, or consequential damages.

We may suspend or terminate owner accounts and listings that:

• Violate these Terms
• Contain misleading, fraudulent, or unlawful content
• Abuse or misuse platform features
• Engage in harmful behavior
• Fail to comply with legal obligations
• Fail to pay for future premium features or subscriptions

Suspension may occur without prior notice if necessary to protect platform integrity.

11. Future Premium Services

We may introduce paid services in the future, including:

• Featured listings
• Paid subscriptions
• Priority placement
• Marketing packages
• Promotional campaigns

Any premium services will be governed by additional terms and pricing, published when available.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of South Africa.

Any disputes will be subject to the jurisdiction of the courts of KwaZulu-Natal (Durban).
